These terms set out the basis on which you may use our website and book tutoring with us. Please read them carefully. By using this website, booking a session, or buying a block or subscription, you agree to these terms.
1. Who we are
This website is operated by JADAMSTUTOR LTD, a company registered in Scotland under company number SC871178. Our registered office is 15 Malletsheugh Wynd, Newton Mearns, Glasgow, Scotland, G77 6WX. In these terms, "we", "us" and "our" refer to JADAMSTUTOR LTD, and "you" and "your" refer to the person using our website or buying from us.
Our website is jadamstutor.com. If you need to contact us about these terms, or about anything you have bought from us, email [email protected] or call 07757 670181. We respond to enquiries from Monday to Thursday.
2. What we provide
JADAMSTUTOR provides online one-to-one tutoring for school pupils, including exam preparation, homework support and feedback on progress. Through this website we offer:
- Single sessions. One-to-one tutoring sessions with a named tutor, each lasting 60 minutes, booked and paid for individually.
- Subscriptions. A recurring monthly subscription, sometimes called a block, which includes a set number of sessions in each billing period.
Each of these is covered in more detail below. The sessions included, the price and the billing period are shown at the point of sale. Where a specific offer has its own additional terms, we will make them clear before you buy, and they take priority for that purchase.
3. Using our website
You may use our website for lawful purposes only. We grant you a personal, non-exclusive and non-transferable right to access and use the website for your own information and to book tutoring with us.
We may update, change or withdraw any part of the website at any time. We do not guarantee that the website, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of the website for business and operational reasons.
We use the personal information you give us to arrange and deliver tutoring, as set out in our Privacy Policy.
4. Booking sessions
Sessions are booked through the calendar on our website, which is run on Acuity Scheduling, an external booking platform. When you book you are subject to Acuity's own terms and privacy policy in addition to these terms. We are not responsible for the Acuity platform itself, but we remain responsible to you for delivering the session you have booked.
To book, you choose a tutor, a date and a time. Payment is required to confirm your booking. Your booking is confirmed when we send you a confirmation email. If the time you want is not shown on the calendar, contact us and we will try to help.
Each booking is for one named pupil, for the date, time and tutor stated in the confirmation. Sessions take place online by video call. You are responsible for having a suitable device, a working internet connection and a quiet place for the pupil to work.
We will do our best to provide the tutor you booked. If that tutor becomes unavailable, we will tell you as soon as we can and offer another tutor. If you would prefer not to go ahead with a different tutor, clause 7.3 applies.
5. Pupils, parents and guardians
Most of our pupils are under 18. If the pupil is under 16, the booking must be made by a parent or guardian. In that case the parent or guardian is our customer and is responsible for payment, for the accuracy of the details given to us, and for making sure the pupil follows these terms.
A pupil aged 16 or over may book in their own name. We may still ask for the contact details of a parent or guardian.
The safety of pupils matters to us. If you have a concern about a pupil's safety or about the conduct of a tutor, contact us straight away at [email protected].
6. Price and payment
Prices are shown in £ at the point of booking and are the full amount payable. Payment is taken in full when you book or subscribe, through Stripe, our third-party payment processor. We do not store your full card details ourselves. If a price is obviously wrong, we are not obliged to honour it, and we will contact you before taking payment.
6.1 Subscriptions
A subscription is a recurring monthly purchase that includes a set number of sessions. By subscribing, you authorise us, through our payment processor, to charge the subscription fee for each billing period until you cancel.
Sessions included in a subscription must be booked within 50 days of the date of purchase or renewal. Sessions that are not booked within that time expire and do not carry over.
6.2 Billing and renewal
Unless stated otherwise at the point of purchase, a subscription renews automatically at the end of each billing period, and the fee for the next period is charged to your payment method on or around the renewal date. We charge the price in force at the time of renewal. We will give you reasonable notice of any change to your subscription price before it takes effect.
6.3 Cancelling a subscription
You may cancel your subscription at any time, with effect from the end of your current billing period. To cancel, contact us at [email protected] or use any cancellation option made available to you. Your subscription continues until the end of the period you have paid for and is not renewed after that. We do not provide pro-rata refunds for the unused part of a billing period unless the law requires it.
7. Cancelling, rescheduling and missed sessions
7.1 Cancelling or rescheduling by you
All cancellation and rescheduling requests must be made no later than 48 hours before the session start time. You can do this using the link in your booking confirmation email or by contacting us. Where you give at least 48 hours' notice, you may move the session to another available time at no charge.
Where you give less than 48 hours' notice, the session is charged in full and is not refunded or replaced.
7.2 Missed sessions and late arrival
We do not offer refunds for failure to attend a session. If the pupil arrives more than 10 minutes late, the session is forfeited without refund. If the pupil arrives late but within 10 minutes, the session goes ahead and still ends at the scheduled time.
7.3 Changes and cancellation by us
If we have to cancel a session, or the tutor does not attend, we will offer you either another time or a full refund of the price paid for that session. If you booked a particular tutor and do not wish to go ahead with a replacement, the same choice applies. If a tutor is late, we will make up the time lost or refund the part of the session that was missed.
7.4 Your legal right to cancel
If you buy from us online as a consumer, you normally have a legal right to cancel within 14 days of your purchase without giving a reason. To use it, tell us clearly by email at [email protected] within the 14 days.
If you book a session that takes place within those 14 days, you are asking us to begin the service during the cancellation period. If you then cancel, you must pay for any sessions already delivered. Once a session has been delivered in full, you can no longer cancel that session.
Nothing in this clause 7 takes away any right the law gives you. Refunds are made to the original payment method.
8. Conduct in sessions
We want every session to be safe, respectful and productive. We may end a session, or decline further bookings, where a pupil, parent or guardian behaves in a way that is unsafe, abusive, discriminatory or disruptive. No refund is due for a session ended for those reasons. Where it is fair to do so, we will give a warning first.
We do not record sessions. You must not record a session, in audio or video, without our written agreement.
If a session cannot go ahead because of a technical problem on our side, clause 7.3 applies. If the problem is with your device or connection, we will do what we reasonably can to help, but the session is treated as a missed session under clause 7.2.
9. Results
Our tutors provide their services with reasonable care and skill. Tutoring supports a pupil's learning, but results depend on many things outside our control, including the pupil's own effort, attendance and preparation. We do not guarantee any particular grade, exam result or outcome. Feedback on progress is the tutor's honest opinion and is not a prediction of results.
10. Acceptable use
When using our website, booking with us, or taking part in a session, you agree not to:
- break any applicable law or regulation;
- harass, threaten, defame or discriminate against any tutor, pupil or other person;
- make bookings you do not intend to keep, or book in another person's name without their permission;
- copy, share or redistribute our tutoring materials or session content without our permission;
- submit a review that is false, misleading or unlawful;
- introduce any virus, malware or other harmful material, or attempt to gain unauthorised access to our systems; or
- act in a way that damages our reputation or the experience of other pupils.
11. Intellectual property
All content on this website and in our sessions, including text, branding, logos, worksheets, notes, videos, graphics and design, is owned by us or our licensors and is protected by intellectual property laws. The name "JADAMSTUTOR" and our logos are our brand assets.
Pupils may use the materials we provide for their own personal study. You may not copy, reproduce, republish, sell or commercially exploit our content without our prior written permission.
Where you submit content to us, for example a review or testimonial, you grant us a non-exclusive, royalty-free licence to use it in connection with our business, including on our website and in our marketing. We will not publish a pupil's full name, image or results without consent, and for a pupil under 16 that consent must come from a parent or guardian.
12. Limitation of liability
Nothing in these terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be limited or excluded under the law.
Subject to that, we provide tutoring for private and educational use only. We are not liable for any loss of profit, loss of business or loss of business opportunity, and we are not liable for any loss or damage that was not foreseeable at the time you entered into the contract with us. Our total liability to you for any claim arising out of or in connection with a purchase is limited to the amount you paid us for the session or subscription period to which the claim relates.
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach, but we are not responsible for anything outside our reasonable control. Where you buy as a consumer, this clause does not affect your statutory rights.
13. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, such as illness, power or internet outages, failure of a video or booking platform, severe weather, or the act or omission of a third party. Where such an event affects a session you have booked, clause 7.3 applies.
14. Governing law and jurisdiction
These terms and any dispute or claim arising out of them, including non-contractual disputes or claims, are governed by the law of Scotland. You and we both agree that the courts of Scotland have jurisdiction, although if you live in another part of the United Kingdom you may also bring proceedings in your home jurisdiction.
15. Changes to these terms
We may update these terms from time to time to reflect changes in our services, the law or our practices. The version that applies to a booking is the one in force at the time you made it. If you have a subscription, we will give you reasonable notice of any change that affects it, and you may cancel before the change takes effect. We will post the current version on this page, with the "Last updated" date above.
